These Terms of Service ("Terms") govern your access to and use of the website mawebappshub.site and the services provided by MAWebAppsHub ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
1. Services
MAWebAppsHub provides the following services:
- Mobile app design and development (iOS and Android)
- Website design and development
- Digital marketing services (Google Ads, SEO, Social Media)
- UI/UX design and branding
- E-commerce store development
- Ongoing maintenance and support
The specific scope, deliverables, timeline, and pricing for each project will be detailed in a separate Statement of Work (SOW) or Project Agreement provided to each client.
2. Payment Terms
- A 50% non-refundable deposit is required before work begins on any project
- The remaining 50% balance is due upon project completion, before final files or access credentials are delivered
- Monthly retainer services are billed at the beginning of each billing period
- All prices are in USD unless otherwise specified
- Late payments may result in project suspension and may incur a 1.5% monthly late fee
- We accept payment via credit card, bank transfer, PayPal, and other methods outlined in your proposal
3. Project Process and Revisions
- Each project begins with a discovery phase and detailed project brief
- Our standard packages include up to 3 rounds of revisions per deliverable
- Additional revisions beyond the agreed scope will be billed at our hourly rate
- Clients are responsible for providing content (text, images, brand assets) in a timely manner
- Project delays caused by late client feedback or content may extend the delivery timeline
- Major scope changes after project commencement will require a revised quote and agreement
4. Intellectual Property
Upon receipt of full payment:
- All custom deliverables created specifically for your project become your property
- We retain ownership of any pre-existing tools, frameworks, templates, or proprietary code used in the project
- We may use completed work in our portfolio and marketing materials unless you request otherwise in writing
- You represent and warrant that all content you provide does not infringe any third-party intellectual property rights
- Open-source components remain subject to their respective open-source licenses
5. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete project information and requirements
- Provide timely feedback and approvals (within 5 business days of each submission)
- Ensure you have legal rights to all content, images, and materials you provide
- Not use our services for any illegal, harmful, or unethical purposes
- Comply with all applicable laws, including data protection and advertising regulations
6. Limitation of Liability
To the maximum extent permitted by law:
- MAWebAppsHub's total liability for any claims arising from our services shall not exceed the total fees paid by you for the specific project giving rise to the claim
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not responsible for loss of profits, data, or business resulting from service interruptions
- We do not guarantee specific business results, traffic volumes, search rankings, or advertising performance
- Digital marketing results depend on many factors outside our control, including algorithm changes and market conditions
7. Warranties and Disclaimers
We warrant that:
- We will perform services professionally and with reasonable skill and care
- Deliverables will substantially conform to agreed specifications
- We have the right to perform the services described
We disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose. Our website and services are provided "as is."
8. Advertising Compliance
All advertising campaigns managed by MAWebAppsHub will comply with:
- Google Advertising Policies and Google Ads Terms of Service
- Meta (Facebook) Advertising Standards
- The Federal Trade Commission (FTC) guidelines for online advertising
- CAN-SPAM Act for email marketing
- All applicable federal, state, and local advertising laws
Clients are responsible for ensuring that products, services, and claims advertised are accurate, legal, and compliant with applicable laws.
9. Termination
- Either party may terminate a project with 14 days written notice
- Upon termination, you are responsible for payment of all work completed to date
- The initial 50% deposit is non-refundable once work has commenced
- We reserve the right to immediately terminate services for violation of these Terms
- Upon termination, we will deliver all completed work product for which payment has been received
10. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the project. This obligation survives termination of the agreement.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New Jersey.
12. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in New Jersey, in accordance with the rules of the American Arbitration Association.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the revised Terms.
